What are the advantages?
Companies that purchase original works of art from living artists and record them as fixed assets can deduct 100% of the price of the work from pre-tax profit in equal installments over 5 years (20% per year).
Beyond this 5 p.mille, or in the event of a deficit financial year, the surplus can be carried forward to the following 5 financial years up to a limit of 5 p.mille. (art. 238bis 1 of the CGI).

For whom?
This tax exemption applies to companies subject to corporate tax, income tax in the industrial and commercial profits (BIC), non-commercial profits (BNC), or agricultural profits (BA) categories. Companies must be subject to a real tax regime. Of course, all liberal professions are eligible for these benefits.

For what ?
In return for this tax benefit, the company is obliged to exhibit the work to the "public" free of charge for the five-year period provided for by law.
The companies concerned are companies subject to corporate tax, income tax in the BIC, BNC or BA category.
An alternative ceiling of 20,000 euros has been put in place for SMEs/VSEs (excluding the calculation of 5 p.mille) in order to encourage sponsorship activities.
